Can you claim innocent spouse to allow a portion of a tax refund not be siezed to pay back student aid?

my wife and i file taxes jointly, i owe back student loans and the irs is going to sieze our refund. can my wife claim innocent spouse, and if so how? i live in NY state if that helps
